1. Scope and Provider

These Terms and Conditions (“Terms”) govern access to and use of the 3D Map Generator website, account, web application, and related software and services (“Services”). The Services are provided by:

In these Terms, “Provider”, “we” and “us” mean Michael Tzscheppan. “You” means the person or business using the Services. If you use the Services on behalf of a business, you confirm that you are authorized to bind that business to these Terms.

2. Services

The Services allow users to select geographic areas, create and edit 3D map projects, and generate exports in the formats made available in the application. Some tools, including the free heightmap generator, may be available without a paid license. Paid features and exports require the applicable Single Map License or an active subscription.

We may update or modify the Services for technical, security, legal, or operational reasons. We will respect applicable statutory rights and provide notice where required by law. Nothing in these Terms gives us the right to remove a paid entitlement contrary to applicable law or the terms of the applicable purchase.

3. Accounts and User Responsibilities

Some features require an account. You are responsible for providing accurate account information, keeping your login credentials secure, and activity carried out through your account. You must not use the Services unlawfully, interfere with their security, or attempt to bypass payment or access controls.

You must have the rights or permissions needed to use any routes, images, text, or other content that you upload or include in a project. You must not upload content that infringes another person’s rights or violates applicable law.

4. Map Projects, Local Files, and Temporary Storage

Map projects are not permanently stored in an online map library. Project files using the .3dmap format are intended to be downloaded and kept by you on your own device or storage service. You are responsible for keeping backup copies of your project files and exported files.

Maps and generated assets held in a temporary server workspace are automatically deleted after 24 hours without activity. Temporary server storage is not a backup or permanent archive. We may retain account, purchase, license, and transaction records as necessary to provide the Services, verify entitlements, meet legal obligations, and protect our rights.

To reopen and edit a local project file, you must be signed in and the map must be covered by a valid entitlement: an applicable Single Map License or an active subscription. A project file does not itself create, transfer, or change a license or payment entitlement.

5. Third-Party Data, Attribution, and Accuracy

The Services may use geographic, elevation, terrain, and basemap data supplied by third parties, including open-data and government sources. The applicable source and license may vary by map area and layer. Rights in third-party data remain with their respective owners and providers.

You must preserve required attribution and comply with the applicable terms for each data source. You must not remove or obscure attribution, copyright notices, logos, watermarks, or source links where their display is required by the applicable terms. A commercial-use entitlement from us does not override restrictions or attribution requirements imposed by a third-party data provider.

Geographic coordinates, elevation models, boundaries, and other map data may be incomplete, outdated, or inaccurate. The Services and data are provided subject to applicable statutory rights and, to the extent permitted by law, without a guarantee that they are suitable for a particular purpose. You are responsible for checking information before relying on it.

Maps and GPX tracks are intended for visualization, planning, and design. They must not be relied on for real-time navigation, emergency response, life-safety decisions, or other uses requiring verified precision.

6. Products, Licenses, and Entitlements

Single Map License: A Single Map License is a one-time purchase for the specific map associated with that purchase in your account. It includes the available export formats, commercial use of outputs generated under that license, and access to the Blender and WordPress add-ons. The license covers that map and its revisions; it cannot be reassigned to a different map by changing a project file. You must be signed in to use the associated editor entitlement.

Monthly and Yearly Subscriptions: An active subscription allows you to create and work with an unlimited number of maps during the subscription period and provides access to the features and exports shown at checkout. Commercial use of outputs generated and downloaded while the subscription is valid continues for those outputs, subject to applicable third-party data terms. A subscription does not create permanent online storage for map projects.

When a subscription is cancelled, it remains available until the end of the already-paid billing period. Cancellation stops future renewals; it does not normally refund the unused remainder of the current period, subject to any mandatory statutory rights. After the subscription expires, further map creation, project import, editing that requires a paid entitlement, and new exports require an active subscription or an applicable Single Map License.

Access to the add-on downloads is available through the account dashboard while your account has an applicable Single Map License or active subscription. Use of an add-on is limited to maps and outputs covered by the relevant entitlement and these Terms.

Prices, billing interval, applicable taxes, and the specific features included in a product are shown in the checkout before you place your order. The checkout information for the product you select forms part of the purchase offer.

7. Orders, Payment, and Lemon Squeezy

Lemon Squeezy acts as the Merchant of Record for purchases made through its checkout. Lemon Squeezy handles payment processing, applicable transaction taxes, receipts, and billing administration under its buyer terms. The product license and use of our Services are governed by these Terms and the product description shown at checkout. If the checkout or order confirmation identifies a different contracting party or supplier, that information must be read together with these Terms.

Subscriptions renew automatically for the billing interval shown at checkout until cancelled. You may cancel through the Lemon Squeezy subscription management portal linked from your account or order emails. Cancellation takes effect at the end of the current paid billing period, and no further renewal payment should be collected after that date. Billing, renewal dates, and any payment retries are handled in accordance with the checkout terms and Lemon Squeezy’s applicable buyer terms.

Access to paid features is enabled after the purchase or subscription has been confirmed. If an entitlement is not activated after successful payment, contact us at support@3d-map-generator.com and include the order number and the email address used at checkout.

8. User Content and Intellectual Property

You retain your rights in text, images, routes, and other content that you provide. You grant us a limited, non-exclusive right to receive, process, display, and temporarily store that content only as necessary to operate the Services, create your requested project or export, provide support, and enforce these Terms.

The website, application interface, software, branding, and materials created by us are protected by intellectual property laws. Except for the licenses expressly granted in these Terms or at checkout, no ownership rights in our software or branding are transferred to you. Nothing in this section restricts rights that cannot lawfully be restricted, including applicable rights concerning open-source components.

9. Right of Withdrawal for Consumers

If you are a consumer, you may have a statutory right to withdraw from a distance contract within 14 days. The withdrawal period and the party to whom a withdrawal must be sent depend on the contract and applicable law. The checkout and order confirmation identify the Merchant of Record and provide the relevant transaction contact details. You may also contact us at support@3d-map-generator.com; we will direct your request to the appropriate party where necessary.

The right of withdrawal does not automatically expire merely because access to the platform begins. Different statutory rules apply to digital content supplied without a physical medium and to ongoing digital services, including subscriptions. Any early commencement of performance and any loss or limitation of a withdrawal right will apply only where the required express consent, acknowledgement, and confirmations have been obtained and the statutory conditions are met.

Where the law permits a consumer to withdraw after requesting that a paid service begin during the withdrawal period, the consumer may be required to pay a proportionate amount for the service supplied before withdrawal. Mandatory consumer rights are not excluded or limited by these Terms.

Model withdrawal statement: To exercise a right of withdrawal, send a clear statement identifying the purchase and your decision to withdraw to the Merchant of Record using the contact details in your order confirmation. 10. Statutory Rights, Warranty, Refunds, and Liability

Your statutory rights, including rights relating to defective or non-conforming digital products and services, remain unaffected. Please contact us promptly if an export, project file, add-on, or other paid feature does not work as described.

Refund requests are handled through Lemon Squeezy’s applicable process. Any voluntary refund policy does not restrict statutory withdrawal, warranty, or other mandatory consumer rights.

We are liable without limitation for intent, gross negligence, injury to life, body or health, fraudulent concealment, an expressly given guarantee, and liability that cannot be excluded by law. In cases of slight negligence, we are liable for a breach of an essential contractual obligation only for the foreseeable damage typical for this type of contract. An essential contractual obligation is one whose fulfilment is necessary for the proper performance of the contract and on which you may ordinarily rely. Any further limitation of liability applies only to the extent permitted by law.

Nothing in these Terms excludes liability for mandatory statutory product liability or other liability that cannot legally be excluded. We are not responsible for damage caused by your use of geographic data for navigation or safety-critical purposes contrary to these Terms, subject to mandatory law.

11. Suspension and Termination

We may suspend access where reasonably necessary to address a security risk, suspected fraud, unlawful use, or a material breach of these Terms. Where appropriate and legally permitted, we will notify you and give you an opportunity to resolve the issue. Suspension or termination does not remove statutory rights or any paid entitlement that must remain available under applicable law.

12. Changes to These Terms

We may update these Terms for future use of the Services. Changes to an existing paid contract will apply only where permitted by law and, where required, after notice and your consent. The applicable version and date of these Terms will be published on this page.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of Germany, without depriving consumers of mandatory protections provided by the laws of their country of habitual residence. For business customers, Berlin is the place of jurisdiction where legally permitted. Mandatory consumer rights and statutory courts remain unaffected.

14. Privacy

Our Privacy Policy explains how personal data is processed. Lemon Squeezy separately processes payment and billing information under its own privacy terms. Please review both policies before using paid Services.
